OFFER
Public Offer Agreement for Charitable Donation (Assistance)

The text of the Agreement below is addressed to individuals and/or legal entities and is an official public offer (in accordance with Article 641 of the Civil Code of Ukraine) of the CHARITABLE FOUNDATION "CHILDREN’S FUTURE," represented by the Foundation's Director, Yevheniya Dmytrivna Stetsiuk, acting under the Statute (hereinafter referred to as the "Foundation"), to enter into a charitable donation agreement (assistance) under the conditions specified below. A public offer (Offer) refers primarily to the opportunity for individuals to voluntarily and willingly provide charitable assistance (donation) through the Foundation.

1. Subject of the Agreement

Charitable assistance (donation) refers to the voluntary transfer of funds by a person (donor) to the ownership of the Foundation for the purpose of the Foundation's further use and achievement of its goals as defined in the Statute or Foundation programs, in accordance with the Law of Ukraine "On Charitable Activities and Charitable Organizations," the Foundation's Statute, and the Terms of this Offer. By accepting the Offer (i.e., by accepting the Offer through actions or transferring funds), the person making the donation (Donor) confirms that they agree to all the conditions of the Offer, understand it, and agree to it.
This Agreement does not entail direct or indirect profit for the Donor. The procedure for general access to the Foundation's financial reports is available on the website: https://childrensfuture.org.ua/.

2. Rights and Obligations of the Donor

The Donor undertakes to:

familiarize themselves with the Statute of the Charitable Organization;
comply with the requirements of this Agreement.

The Donor has the right to:

exercise control over the use of charitable assistance (donation) by the Foundation for the intended purpose;
review the reports on the provision of charitable assistance posted on the website and official pages.

3. Rights and Obligations of the Foundation

The Foundation undertakes to:

use the charitable assistance received from the Donor in accordance with its designated purpose and in compliance with the requirements of the Statute, terms of the Offer, and applicable laws of Ukraine;
provide the Donor, upon request, with a report on the donation in the manner, timeframe, and form approved by the Foundation based on the requirements of the applicable laws of Ukraine;
provide the Donor, upon request, with any statutory documents of the Charitable Organization.

The Foundation has the right to use a portion of the charitable assistance for administrative expenses of the Foundation, not exceeding the limits specified by the Law of Ukraine "On Charitable Activities and Charitable Organizations."

4. Guarantees of Charitable Assistance

The Foundation undertakes not to allow the use of the donation for any purpose other than specified in this Offer and the statutory activities and programs of the Foundation. The fulfilment of the conditions of this Offer is not intended for direct or indirect profit.

5. Duration of Charitable Assistance

The receipt of charitable assistance (donation), funds transferred to the ownership of the Foundation for the Foundation's subsequent use and achievement of its goals as defined in the Statute or Foundation programs, continues until the termination of the Foundation's activities unless otherwise determined by its governing bodies. From the moment of accepting the Offer, this Agreement is considered concluded in writing in accordance with Articles 207, 639, 641, and 642 of the Civil Code of Ukraine and Articles 6 and 7 of the Law of Ukraine "On Charitable Activities and Charitable Organizations."

Consent-Notification for the Collection, Processing, and Use of Personal Data

The Donor, the person who has accepted this Offer, voluntarily and without coercion, confirms that, in accordance with the provisions of the Law of Ukraine "On Personal Data Protection," they give consent to the other Party (the Foundation) to process their personal data for the purpose of ensuring the implementation of economic relations, tax relations, and accounting relations.
The person also confirms that they have been informed about the inclusion of their personal data in the personal data database of the Foundation, the actual scope of the transferred data corresponds to the purposes of processing, and about the rights of the data subject as defined by Article 8 of the Law of Ukraine "On Personal Data Protection."
The Party of the Agreement that has received the personal data of the representative of the other Party is obliged to ensure their protection against unlawful processing and unauthorized access in accordance with the requirements of Article 24 of the Law of Ukraine "On Personal Data Protection" and other requirements provided by the current legislation of Ukraine.
This consent-notification is valid indefinitely.
